FOREWORD

The above-mentioned companies are sister companies with a shareholding restricted to family members and/or close relatives. The companies mutually undertake to provide services which are connected with, or may be connected with, the accommodation or catering agreement concluded by the guest or any other purchase agreement for one of the services offered. Both companies take the protection of their customers' personal data very seriously and therefore equally undertake to comply with the requirements of the Swiss Federal Act on Data Protection (DSG) as well as the European General Data Protection Regulation (DSGVO). Both companies understand themselves congruently as the responsible entity and a request for information, blocking, deletion and the like is automatically carried out by both entities equally, even if only one entity is contacted in this regard.

GENERAL INFORMATION

The following explains what personal data the companies collect, at what point, how, where and for what purpose it is stored and processed, and what rights and options are associated with it.

What are personal data?

Personal data are all data by which a guest could be personally identified.

How is such data collected?

On the one hand, such data may be provided personally by guests as part of a hotel or table reservation, whether by telephone, fax, e-mail, letter or in person on site. It may also be transmitted to the contractual partner by a third party (an intermediary). Data are also transmitted to us when ordering vouchers and purchasing promotional items or other goods & services. In doing so, we limit ourselves exclusively to the data necessary for the fulfilment of the contract or pre-contractual measures.
On the other hand, the data may automatically reach us via our website, the WiFi access or via our social media channels; these are usually technical data collected by the IT systems (e.g. operating system, time and origin of the page view or internet browser etc.).

For what purpose are the data collected and processed?

First and foremost, this is about the fulfilment of contracts, for example in connection with the guest admission contract or a reservation. If the contract is concluded, legal obligations may arise from this, such as the statutory registration obligation. It is also quite possible that we have a legitimate interest, which requires that personal data are known and/or processed, for example to improve our direct service (e.g.: preferred mattress firmness). Finally, it is about improving our communication by analysing user behaviour and ensuring that the website is provided without errors. As a rule, however, we obtain explicit consent for this in each case.

What rights do customers retain regarding their data?

Our customers have the right at any time and free of charge to receive information about the origin, recipients and purpose of the data stored by the companies. In addition, there is the right at any time and free of charge to delete or block the data and also to transfer the data to a third party in a machine-readable format on the basis of the customer's consent. All this can be done by simply contacting us with an informal message, for example by e-mail to one of the responsible entities mentioned above. Of course, any consent may be withdrawn by the customer at any time and completely without justification, free of charge. An informal e-mail to the address mentioned in the Imprint is sufficient for this as well.

Objection to promotional e-mails

The use of the information from the above-mentioned Imprint to send unsolicited advertising and information material is hereby clearly rejected and the companies expressly reserve the right to take legal action in the event of a breach of this point.

1. Information gathering

We collect information when you register on our website, log into your account, make a booking, take part in a competition and/or log out. The information collected includes your name, e-mail address, telephone number and/or credit card. In addition, we automatically receive and store information from your computer and browser, including your IP address, software and hardware and the page you requested.

2. Use of information

All information we collect from you may be used to:

  • personalise your experience and meet your individual needs
  • provide personalised advertising content
  • improve our website
  • improve our customer service and your support needs

3. Data protection in online commerce

We are the sole owners of the information collected on this website. Your personal data will not be sold, exchanged, transferred or passed on to another company without your consent, unless this is necessary to fulfil a request and/or transaction, e.g. to send an order or to order a stay card with customer benefits.

4. Disclosure to third parties

We do not sell, trade or transfer your personal data to third parties. This does not apply to reliable third parties who support us in managing our website or in conducting our business, provided that they undertake to keep the information confidential.
We think it is necessary to exchange information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations in which the physical safety of a person could be endangered, breaches of our terms of use or where this is required by law, in accordance with the legal obligations of municipal, cantonal or national authorities. Non-private information may, however, be made available to other parties for marketing, advertising or other purposes.

5. Information protection

We implement a variety of security measures to protect your personal data. We use state-of-the-art encryption technology to protect confidential information transmitted online. We also protect your data offline. Only employees who need to perform certain tasks (e.g. invoicing or customer service) have access to personal data. The computers and servers used to store personal data are kept in a secure environment.

Do we use cookies?
Yes. Our cookies improve access to our website and identify regular visitors. In addition, our cookies improve the user experience by tracking and targeting their interests. However, this use of cookies is in no way linked to personally identifiable information on our website.

6. Unsubscribe

We use the e-mail address you provide to send you information and updates regarding your order, occasional company news, information about related products, etc. If you unsubscribe and no longer wish to receive e-mails, you will find an unsubscribe link at the end of each e-mail.

CONTACT FORM

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.
The data entered into the contact form are therefore processed exclusively on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). You may revoke this consent at any time. An informal message by e-mail to us is sufficient. The lawfulness of the data processing operations carried out up to the point of revocation remains unaffected by the revocation.
The data you enter in the contact form remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

DATA PROCESSING
Zermatt Tourismus and Bonfire AG

Your booking data are also processed as follows:

  • Your booking data (e.g. salutation, first name, surname, date of birth, nationality, language, e-mail address, mobile telephone number, postal address, number of persons, arrival date, departure date, overnight stays and any exemption from tourist tax) are forwarded to Bonfire AG and Zermatt Tourismus (either by us or via our electronic booking system). 
  • Your booking data are recorded in a central database by Bonfire AG and/or Zermatt Tourismus. If accommodation providers take part in Zermatt Tourismus e-mail marketing, the guest data are also stored with the third-party provider «Salesforce» and used within the business relationship between the accommodation provider and the guest. 
  • Your booking data are processed exclusively in Switzerland and the EU.
  • On this basis, Zermatt Tourismus invoices the tourist tax due and carries out the corresponding collection from the service partners.
  • Zermatt Tourismus also reports to the Federal Statistical Office.
  • Bonfire AG and Zermatt Tourismus grant the police access to the database with booking data so that the police can, for example, retrieve the relevant booking data in the case of missing persons.
  • Zermatt Tourismus uses the booking data to collect statistics (in particular on occupancy, length of stay, number of arrivals, etc.).

The legal basis for this data processing lies in the fulfilment of a legal obligation within the meaning of Art. 6 para. 1 lit. c DSGVO (invoicing and collection of tourist tax / reporting to the Federal Statistical Office) or in safeguarding a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO (granting access to the police / collection of statistics). 

Your booking data will only be used for direct marketing purposes (e.g. newsletter mailing) if you have given us your consent to do so.

Our website uses the visitor action pixel of Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”), for conversion measurement.
This enables the behaviour of site visitors to be tracked after they have been redirected to the provider's website by clicking on a Facebook advert.
