FOREWORD

The above-mentioned companies are sister companies with a shareholding structure restricted to family members and/or close relatives. The companies mutually undertake to provide services that are or may be related to the accommodation, catering contract or any other purchase contract concluded by the guest for one of the services offered. Both companies take the protection of their customers' personal data very seriously and therefore undertake equally to comply with the requirements of the Swiss Federal Act on Data Protection (DSG) and the European General Data Protection Regulation (GDPR). Both companies understand themselves congruently as the responsible party, and a request for information, blocking, deletion and the like is automatically carried out equally by both parties, even if only one party is contacted in this regard.

GENERAL INFORMATION

Below we explain what personal data the companies collect, at what point, how, where and for what purpose it is stored and processed, and what rights and options are associated with it.

What are personal data?

Personal data are all data by which a guest could be personally identified.

How are such data collected?

On the one hand, such data may be communicated personally by guests as part of a hotel or table reservation, by telephone, fax, e-mail, letter or in person on site. They may also be transmitted by a third party (an intermediary) to the contractual partner. Data are also transmitted to us when gift vouchers are ordered and promotional items or other goods & services are purchased. In doing so, we limit ourselves exclusively to the data necessary for fulfilling the contract or the pre-contractual measures.
On the other hand, data may reach us automatically via our website, the WiFi access or our social media channels; these are usually technical data collected by the IT systems (e.g. operating system, time and origin of the page view or internet browser, etc.).

For what purpose are the data collected and processed?

Primarily this is about fulfilling contracts, for example in connection with the guest accommodation contract or a reservation. If the contract is concluded, legal obligations may arise from this, such as the statutory reporting obligation. It is also entirely possible that there is a legitimate interest on our part, which requires personal data to be known and/or processed, for example to improve our direct service (e.g. preferred mattress firmness). Finally, the aim is to improve our communication by analysing user behaviour and ensuring that the website is provided without errors. In principle, however, we always obtain explicit consent for this.

What rights do customers retain with regard to their data?

Our customers have the right at any time and free of charge to receive information about the origin, recipient and purpose of the data stored by the companies. In addition, there is the right at any time and free of charge to have the data deleted or blocked, as well as to have the data transferred to a third party in a machine-readable format on the basis of the customer's consent. All this is done by simply contacting us with an informal message, for example by e-mail to one of the responsible offices mentioned above. Naturally, any consent may be withdrawn by the customer at any time and completely without justification, free of charge. For this too, an informal e-mail to the address mentioned in the legal notice is sufficient.

Objection to advertising e-mails

The use of the information from the legal notice listed above for sending unsolicited advertising and information material is hereby expressly rejected and the companies expressly reserve the right to take legal action in the event of a breach of this point.

In the context of fulfilling our service contract, we generally assume the following standard communication, in which personal data are processed: Offer | Confirmation | Pre-Stay Mail 1 (for information about arrival and additional design of the experiences on site) | Pre-Stay Mail 2 (for information about the weather and pickup service as well as table reservations).

1. Information collection

We collect information when you register on our website, log into your account, make a booking, take part in a competition and/or log out. The information collected includes your name, your e-mail address, your telephone number and/or your credit card. In addition, we automatically receive and store information from your computer and browser, including your IP address, software and hardware, and the page you requested.

2. Use of information

All information we collect from you may be used for:

3. Data protection in online retail

We are the sole owners of the information collected on this website. We do not sell, trade or transfer your personal data to third parties. This does not apply to reliable third parties who assist us in operating our website or conducting our business, provided they agree to keep the information confidential.
We believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations where the physical safety of a person may be endangered, violations of our terms of use or where required by law, in accordance with the legal obligations of municipal, cantonal or national authorities. Non-private information may, however, be provided to other parties for marketing, advertising or other purposes.

4.1. Data protection and participant identification

Data from the individual Romantik Hotels are also transmitted to Romantik Hotels & Restaurants AG and processed there.

5. Information protection

We implement a variety of security measures to protect your personal data. We use state-of-the-art encryption technology to protect confidential information transmitted online. We also protect your data offline. Only employees who need to perform certain tasks (e.g. invoicing or customer service) have access to personal data. The computers and servers used to store personal data are kept in a secure environment.

Do we use cookies?
Yes. Our cookies improve access to our website and identify regular visitors. In addition, our cookies improve the user experience by tracking and targeting their interests. However, this use of cookies is in no way linked to personally identifiable information on our website.

6. Unsubscribe

We use the e-mail address provided by you to send you information and updates regarding your order, occasional company news, information about related products, etc. If you unsubscribe and no longer wish to receive e-mails, you will find an unsubscribe link at the end of each e-mail.

CONTACT FORM

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We will not pass on this data without your consent.
The data entered in the contact form is therefore processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You may withdraw this consent at any time. All that is required is an informal message by e-mail to us. The lawfulness of the data processing carried out up to the point of withdrawal remains unaffected by the withdrawal.
The data you enter in the contact form will remain with us until you request its deletion, withdraw your consent to storage or the purpose for data storage no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

DATA PROCESSING
Zermatt Tourismus and Bonfire AG

Your booking data will also be processed as follows:

  • Your booking data (e.g. salutation, first name, surname, date of birth, nationality, language, e-mail address, mobile phone number, postal address, number of persons, arrival date, departure date, nights and any exemption from tourist tax) will be forwarded to Bonfire AG and Zermatt Tourismus (either by us or via our electronic booking system).
  • Your booking data will be recorded in a central database by Bonfire AG and/or Zermatt Tourismus. If accommodation providers participate in Zermatt Tourismus e-mail marketing, the guest data are also stored with the third-party provider «Salesforce» and used within the business relationship between the accommodation provider and the guest. 
  • Your booking data will be processed exclusively in Switzerland and the EU.
  • On this basis, Zermatt Tourismus carries out the accounting of the tourist tax owed and the corresponding collection from the service partners.
  • Zermatt Tourismus also reports to the Federal Statistical Office. 
  • Bonfire AG and Zermatt Tourismus grant the police access to the database with booking data so that the police can retrieve the relevant booking data, for example in the case of missing persons.
  • Zermatt Tourismus uses the booking data to collect statistics (in particular regarding occupancy, length of stay, number of arrivals, etc.).

The legal basis for this data processing lies in the fulfilment of a legal obligation within the meaning of Art. 6(1)(c) GDPR (accounting and collection of tourist tax / reporting to the Federal Statistical Office) or in the protection of a legitimate interest within the meaning of Art. 6(1)(f) GDPR (granting access to the police / collection of statistics). 

Your booking data will only be used for direct marketing purposes (e.g. newsletter mailings) if you have given us your consent to do so.

As part of Google AdWords, we use what is known as conversion tracking. When you click on an advert placed by Google, a cookie for conversion tracking is set.
